Medical Malpractice

NY Medical Malpractice Lawyers Serving All of New York

Medical malpractice is the act in which a doctor, surgeon, or other licensed healthcare provider acts negligently, causing injury or death in a patient. Patients expect a timely diagnosis of a medical problem along with proper treatment. In some cases a delay in diagnosis may have serious consequences to the patient and may affect their quality of life.

Doctors and other medical staff are professionals and respected by the community. It is their duty to safely and correctly treat patients with the individual's best interest and health in mind. Some types of medical negligence may be:

  • Delay in diagnosis
  • Anesthesia error
  • Improper consent before a medical procedure
  • Surgical error
  • Failure to diagnose a medical condition
  • Improper treatment of an illness or disease
  • Birth injury, including Cerebral Palsy and brain damage
  • Prescription drug error
  • Negligence

Nursing Home Abuse

When individuals make the difficult decision to place one of their loved ones into a care facility, they expect their family members to be taken care of with hospitality and respect. This desire to assume the best in others is natural. Unfortunately, however, nursing home abuse and neglect doesn't just occur, it occurs regularly.

The majority of instances of nursing home neglect are the result of poorly trained staff or insufficient staffing. In the worst cases, staff members will purposefully harm elderly residents who cannot defend themselves. Common injuries can include but are not limited to: poor nutrition, bed sores, falls, leading to broken hips, joints and other bones, dehydration, medication and drug administration errors, and assault, sexual assault.

There is no excuse for health care providers to mistreat patients in nursing homes, hospitals or other facilities. Contact the experienced attorneys at Elovich & Adell to learn more about your options for recovery and how our firm can actively protect your loved ones.

Birth Defects

Whether it’s the joy of becoming new parents or the delight of receiving another child, nothing can be worse than having your child suffer a birth defect. A birth injury can occur at many different times throughout the birthing process and the birth injuries can vary from being very minor to catastrophic and can even result in death. Typical birth defects and injuries include but are not limited to: Erb’s palsy (brachial palsy), facial paralysis caused by forceps, bone fractures, and/or brain injuries from oxygen deprivation.

Carelessness and negligence in the birthing room can lead to several different types of birth injuries. Erb’s palsy is a condition created through dystocia or a difficult birth or labor when the shoulder is caught behind the mother’s pelvic bone, which can permanently damage the muscles and tendons and cripple the arm and hand.

Many parents, sadly, are unaware that their child’s birth defect is truly the result of an injury sustained from medical negligence or carelessness. Cerebral palsy is one condition which may be caused by a number of errors or incidents during birth.
